معالي الأمين العام،
أكتب لكم مرة أخرى بعد الرسالة التي أرسلتها لكم في العاشر من نيسان 2007 حول إنشاء المحكمة الخاصة بلبنان.
كما تذكرون، شرحت في رسالتي السابقة المأزق الذي يسببه رفض رئيس مجلس النواب الدعوة إلى عقد جلسة برلمانية من أجل التصديق بشكل رسمي على النظام الأساسي للمحكمة والاتفاق الثنائي مع الأمم المتحدة. وكما لاحظتم عبر مراسلات عدد من النواب اللبنانيين معكم فقد عبرت الأغلبية النيابية عن دعمها للمحكمة واستعدادها للتصديق عليها بشكل رسمي في البرلمان في حال عقدت جلسة لهذا الهدف. ولسوء الحظ، استمر الوضع على حاله منذ الرسالة الأخيرة التي أرسلتها لكم، كما جاء في التقرير الذي قدمه لكم السيد نيكولا ميشال بعد زيارته بيروت الشهر الماضي.
معالي الأمين العام،
نحن نعتبر إيفادكم السيد نيكولا ميشال في زيارته الأخيرة للبنان خطوة طبيعية ومرحب بها لتمكين الأمانة العامة من تقييم إمكانية التصديق على المحكمة في لبنان ومعرفة آراء الأطراف المختلفة في ما يتعلق بالمحكمة ونظامها الأساسي. ولا بد أن السيد نيكولا ميشال قد أكد في تقريره لكم ولمجلس الأمن أنه (1) عملياً، يمكن القول إن التصديق على المحكمة محلياً وصل إلى طريق مسدود، بسبب عدم إمكانية اجتماع البرلمان لإقرار المحكمة بشكل رسمي؛ و(2) على الرغم من دعمها المعلن إنشاء المحكمة، فقد رفضت المعارضة مناقشة أي تحفظات لديها على النظام الأساسي مع السيد نيكولا ميشال.
معالي الأمين العام،
في ضوء ما ذكرناه آنفاً، تعتبر الحكومة اللبنانية أنه آن الأوان ليساعد مجلس الأمن في جعل المحكمة الخاصة بلبنان واقعاً فعلياً. لذلك، نطلب منكم، وبإلحاح، أن تعرضوا على مجلس الأمن طلبنا وضع المحكمة حيز التنفيذ. فاعتماد مجلس الأمن قراراً ملزماً بشأن المحكمة يتماشى مع الأهمية التي أولتها الأمم المتحدة منذ البداية لهذه المسألة عند تشكيل لجنة التحقيق. إن استمرار تأخير إنشاء المحكمة سوف يؤثر سلباً على استقرار لبنان، و تحقيق العدالة، وصدقية الأمم المتحدة، والسلام والأمن في المنطقة.
أود كذلك أن أطلب منكم توزيع هذه الرسالة على أعضاء مجلس الأمن.
أنتهز هذه الفرصة لكي أعبر لمعاليكم عن تقديرنا لجهودكم الحثيثة.

Further to my letter of April 10, 2007, I write to you again regarding the establishment of the Special Tribunal for Lebanon.
As you will recall, in my aforementioned letter I explained the impasse that had been created by the refusal of the Speaker of Parliament to convene a session of parliament to formally ratify the statutes of the Tribunal and the bilateral agreement with the UN. As you will have also seen from the communication from members of parliament, a parliamentary majority has expressed its support for the tribunal and readiness to formally ratify it in parliament if only a session could be convened. Unfortunately, this situation has continued since my last letter, as also reported to you by Mr. Nicolas Michel after his visit to Beirut last month.
Excellency,
We view Mr. Michel's most recent visit as a natural and welcome step on your part to enable the Secretariat to assess, at firsthand, the prospects of formal domestic ratification of the Tribunal, and the views of various parties regarding the Tribunal and its statutes. Mr. Michel's report to you and to the Security Council will have confirmed that (1) for all practical purposes the domestic route to ratification had reached a dead end, with no prospect for a meeting of parliament to complete formal ratification; and that (2) despite their stated support for the establishment of a Tribunal, the opposition has declined to discuss with Mr. Michel any reservations they may have on any of the agreed statutes.
Excellency,
In light of the above, the Lebanese Government believes that the time has come for the Security Council to help make the Special Tribunal for Lebanon a reality. We therefore ask you, as a matter of urgency, to put before the Security Council our request that the Special Tribunal be put into effect. A binding decision regarding the Tribunal on the part of the Security Council will be fully consistent with the importance the UN has attached to this matter from the outset, when the investigation commission was established. Further delays in setting up the Tribunal would be most detrimental to Lebanon's stability, to the cause of justice, to the UN's own credibility and to peace and security in the region.
I would also like to kindly request that this letter be circulated to members of the Security Council.
